Giligey respects the intellectual property rights of others and expects users of its platform to do the same. This Digital Millennium Copyright Act Policy ("DMCA Policy") describes how Giligey responds to claims of copyright infringement submitted in accordance with the Digital Millennium Copyright Act and similar applicable laws.

1. Overview

If you believe that content available on or through giligey.com infringes one or more of your copyrights, you may submit a written notification to our designated copyright agent as described below. Upon receipt of a compliant notice, Giligey will take appropriate action, which may include removing or disabling access to the allegedly infringing material.

2. Submitting a DMCA Takedown Notice

To be effective under applicable law, your written notification must include all of the following elements:

  1. A physical or electronic signature of a person authorised to act on behalf of the owner of the exclusive right that is allegedly being infringed.
  2. Identification of the copyrighted work claimed to have been infringed. If multiple copyrighted works are covered by a single notification, a representative list of such works is acceptable.
  3. Identification of the material that is claimed to be infringing or to be the subject of infringing activity, and information reasonably sufficient to permit Giligey to locate the material on the platform (for example, a URL or specific page description).
  4. Information reasonably sufficient to permit Giligey to contact you, including your full name, mailing address, telephone number, and email address.
  5. A statement that you have a good-faith belief that use of the material in the manner complained of is not authorised by the copyright owner, its agent, or the law.
  6. A statement that the information in the notification is accurate and, under penalty of perjury, that you are authorised to act on behalf of the owner of an exclusive right that is allegedly infringed.

Incomplete notices may not receive a response. Giligey reserves the right to request additional information before processing any claim.

Please include "DMCA Takedown Notice" in the subject line of any email submission to ensure prompt handling.

3. Counter-Notification Procedure

If you believe that material you posted was removed or disabled as a result of a mistake or misidentification, you may submit a written counter-notification to our designated copyright agent. Your counter-notification must include:

  1. Your physical or electronic signature.
  2. Identification of the material that was removed or to which access was disabled, and the location at which the material appeared before it was removed or access was disabled.
  3. A statement under penalty of perjury that you have a good-faith belief that the material was removed or disabled as a result of mistake or misidentification.
  4. Your full name, mailing address, telephone number, and email address.
  5. A statement that you consent to the jurisdiction of the applicable courts and that you will accept service of process from the person who provided the original notification or an agent of such person.

Upon receipt of a valid counter-notification, Giligey may reinstate the removed material within ten (10) to fourteen (14) business days, unless the original complaining party files a court action seeking to restrain you from engaging in infringing activity before that period expires.

4. Repeat Infringer Policy

Giligey maintains a policy of terminating, in appropriate circumstances, the accounts of users who are deemed to be repeat infringers. A repeat infringer is any user who has been the subject of two or more valid DMCA takedown notices within any rolling twelve-month period, or who Giligey otherwise determines, in its sole discretion, to be a habitual infringer of third-party intellectual property rights.

Giligey reserves the right to terminate any account without prior notice if the account is found to be engaged in systematic or deliberate copyright infringement.

5. Misrepresentation

Please be aware that applicable law provides for significant civil liability for any person who knowingly and materially misrepresents that material is infringing, or that material was removed or disabled by mistake or misidentification. If you are not certain whether material you are reporting infringes your copyright, you should consult a legal advisor before submitting a notice.

Giligey reserves the right to seek damages and legal fees against any party who submits a fraudulent or bad-faith DMCA notification or counter-notification.

6. Modifications to Infringing Content

In some cases, rather than removing content entirely, Giligey may at its discretion:

Any such interim measures do not constitute a final determination of infringement and do not waive any rights of either party.

7. Third-Party Content

Giligey hosts content created and submitted by its users. Giligey does not pre-screen user-submitted content and is not responsible for monitoring the platform for infringing material. However, Giligey will respond expeditiously to valid DMCA notices submitted in accordance with this policy.

The presence of any content on the platform does not constitute an endorsement by Giligey of that content or any associated intellectual property claims.

8. Relationship to Terms of Service

This DMCA Policy is incorporated into and forms part of the Giligey Terms of Service. Users who submit or host content on the platform are required to comply with all applicable intellectual property laws and with the terms of any licences governing content they use. Any violation of this policy may result in suspension or termination of access to the platform in accordance with the Terms of Service.

9. Changes to This Policy

Giligey reserves the right to modify this DMCA Policy at any time. When changes are made, the "Last updated" date at the top of this page will be revised accordingly. Continued use of the platform following any such modification constitutes your acceptance of the updated policy. It is your responsibility to review this policy periodically for any changes.
